Content on the Site, including articles, the Roof Intelligence Series, videos, guides, checklists, and downloadable resources, is provided for general informational and educational purposes only. It is not professional consulting, engineering, architectural, legal, or insurance advice, and it is not a substitute for a site-specific evaluation of your building.

Roofing, waterproofing, and building envelope conditions vary by building, climate, code jurisdiction, and system. Do not make decisions about repairs, replacement, budgeting, warranties, or insurance claims based solely on Site content. Contact a qualified professional for advice about your property.

Using the Site, submitting a form, or communicating with us by email, phone, or text does not create a consultant-client relationship. A professional relationship with BEM begins only when both parties sign a written agreement or proposal defining the scope of services.

Access to BEM client tools, including the BEAM roof asset management platform, and any services we perform are governed by separate agreements and terms. If those terms conflict with these Terms, the separate agreement controls.

The Site and its content, including text, graphics, photographs, logos, the BEM name and monogram, the BEAM name, videos, and downloadable materials, are owned by BEM or its licensors and are protected by copyright, trademark, and other laws.

You may view, download, and print Site content for your personal or internal business use, provided you keep all copyright and proprietary notices. You may not reproduce, modify, distribute, republish, or create derivative works from Site content, or use BEM's names or logos, without our prior written permission. You may share links to Site pages.

You are responsible for the accuracy of information you submit through the Site. If you send us comments, ideas, or suggestions, you grant BEM the right to use them without restriction or compensation. Please do not send confidential or proprietary information through the Site unless we have agreed in writing to receive it. Our collection and use of personal information is described in our Privacy Policy.

The Site may link to or reference third-party websites, manufacturers, products, codes, standards, or organizations. These links are provided for convenience only. BEM does not control or endorse third-party content and is not responsible for its accuracy, availability, or practices. References to a manufacturer or product do not mean BEM endorses it unless we say so expressly.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. BEM DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT IS CURRENT OR COMPLETE. BUILDING CODES, STANDARDS, AND PRODUCT INFORMATION CHANGE, AND SITE CONTENT MAY NOT REFLECT THE LATEST REQUIREMENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, BEM AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR PROPERTY, ARISING FROM YOUR USE OF OR RELIANCE ON THE SITE OR ITS CONTENT. BEM'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO SERVICES PERFORMED UNDER A SEPARATE WRITTEN AGREEMENT, WHICH ARE GOVERNED BY THAT AGREEMENT.

You agree to defend, indemnify, and hold harmless BEM and its owners, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms by posting a revised version with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.

If you are a federal, state, or local government entity or a client under a written contract with BEM, the terms of that contract, including any required government clauses, control over these Terms where they conflict.

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and BEM about your use of the Site.
